2.2 Categories of Personal Data

We collect and process the following categories of personal data: full name, business email address, telephone number, company affiliation, project specifications, and billing information necessary for service delivery.

2.3 Legal Basis for Processing

Personal data is processed under Article 6(1)(b) of the GDPR — performance of a contract — and Article 6(1)(f) — legitimate interest in responding to business inquiries and delivering contracted services.

2.4 Data Retention

Personal data is retained for the duration of the commercial relationship and for a period of five (5) years following the conclusion of the last service engagement, in compliance with French commercial record-keeping obligations. Project-related data may be retained indefinitely where required for service continuity.

2.5 Data Sharing

DigitalStructureWork does not sell, rent, or distribute personal information to unauthorized third parties. Data may be shared with cloud infrastructure providers (AWS, GCP, Azure), payment processors (Stripe), and analytics services strictly necessary for service delivery, all under Data Processing Agreements (DPAs).

2.6 Data Subject Rights

Under the GDPR, you have the right to access, rectify, erase, restrict processing, port, and object to the processing of your personal data. To exercise these rights, contact our Data Protection Officer at [email protected].

2.7 International Data Transfers

Where data is transferred outside the European Economic Area, DigitalStructureWork ensures adequate safeguards through Standard Contractual Clauses (SCCs) approved by the European Commission.

2.8 CCPA Compliance (California Residents)

Section 3

Terms of Service

3.1 Service Agreement

All digital services, software deliverables, and engineering advisory packages provided by DigitalStructureWork are governed by explicitly contracted Statements of Work (SOW) executed between the Client and DigitalStructureWork.

3.2 Intellectual Property

Upon complete settlement of agreed commercial invoices, DigitalStructureWork assigns all worldwide intellectual property rights in the client-specific software deliverables, design tokens, architecture documents, and digital assets directly to the Client. Pre-existing frameworks, libraries, and tools used during development remain the property of DigitalStructureWork.

3.3 Payment Terms

Invoices are payable within fourteen (14) calendar days of issuance unless otherwise agreed in the SOW. Late payments accrue interest at a rate of three percent (3%) per month. DigitalStructureWork reserves the right to suspend service delivery for accounts overdue by more than thirty (30) days.

3.4 Limitation of Liability

DigitalStructureWork's total aggregate liability under any engagement shall not exceed the total fees paid by the Client for the specific service giving rise to the claim. DigitalStructureWork shall not be liable for indirect, consequential, incidental, or punitive damages.

3.5 Confidentiality

Both parties agree to maintain strict confidentiality of proprietary information exchanged during the course of the engagement. This obligation survives the termination of the commercial relationship for a period of three (3) years.

3.6 Termination

Either party may terminate the engagement with thirty (30) days written notice. Upon termination, DigitalStructureWork shall deliver all completed work and transfer all project-related assets to the Client. Fees for work completed prior to termination remain payable.

3.7 Governing Law

These Terms of Service are governed by the laws of the French Republic. Any disputes arising from these terms shall be submitted to the competent courts of Draguignan, Var, France.
